The pheonix was not something from Yamamoto's, it was the bill. That's why it only appears during executions, because the pheonix = bill.

I see what he meant i completly forgot about that. But still does that really count? Not as if that execution blade really counts as an individuals Zanpakuto. Since they use it for executions only must be something special about the Pheonix. But wouldn't it be great if Captain-Commander's Zanpakuto was like the X-Men looking Pheonix (Jean Grey); but obviously better..?

don't know but i do find that interesting how the phoenix works exactly.

The pheonix is made up of over 1000 shinigami souls or something like that, possibly all the souls of the people that were executed. It is likely it is some kind of kido put on the original bill at some point, to enhance its abilities.
